These Terms & Conditions govern the use of our website, booking services, and participation in tours operated by MOBYDICK-TOURS, LDA.
By accessing our website, making a reservation, or participating in any tour, you agree to be legally bound by these Terms & Conditions.

2. SERVICES
Moby Dick Tours provides maritime tourism experiences, including but not limited to:

dolphin watching tours

marine wildlife excursions

private charters
-
custom tourism experiences
-
related maritime tourism activities
All services are subject to operational availability, weather conditions, safety requirements, and applicable maritime regulations.
3. BOOKINGS
Reservations may be made through our website, direct communication channels, or approved booking systems.
A booking is considered confirmed only after:

successful payment

receipt of booking confirmation
-
acceptance by Moby Dick Tours
Moby Dick Tours reserves the right to reject or cancel bookings in exceptional operational circumstances.
4. PRICING
All prices displayed are in EUR (€) unless otherwise stated.
Prices may vary depending on:

Applicable taxes are included where legally required unless otherwise specified.
5. PAYMENT TERMS
Payments are securely processed via Wix secure payment infrastructure and authorized payment providers.

All payment processing uses encrypted security protocols.
Moby Dick Tours does not store full payment card information.
Failure of payment authorization may result in cancellation of reservation.
6. CANCELLATION POLICY
Customer Cancellation
Customers may cancel their booking free of charge up to 24 hours before the scheduled departure time.
Approved cancellations within this period are eligible for a full refund.
Cancellation requests made less than 24 hours before departure may not be eligible for refund.
No-Show Policy
Failure to attend the scheduled departure without prior cancellation constitutes a no-show.
No-shows are strictly non-refundable.
7. WEATHER / OPERATIONAL CANCELLATIONS
Moby Dick Tours reserves the right to cancel, postpone, modify, or reschedule tours due to:

unsafe sea conditions

severe weather
-
technical issues
-
operational constraints
-
maritime authority restrictions
-
force majeure circumstances
-
safety considerations
In such cases, customers may receive:

full refund OR
-
rescheduled booking (subject to availability)
Moby Dick Tours shall not be liable for indirect travel costs, including:

flights
-
accommodation
-
transportation
-
missed activities
-
incidental expenses
8. WHALE & DOLPHIN SIGHTING GUARANTEE
Moby Dick Tours offers a whale and dolphin sighting guarantee for applicable shared whale watching tours.
If no whales or dolphins are observed during the scheduled qualifying tour, the customer may be eligible for a full refund, subject to internal operational verification.
This guarantee applies only where explicitly stated and does not apply in cases involving:

customer disruption
-
weather interruption
-
shortened tours caused by force majeure
-
customer misconduct
-
early voluntary departure
Marine wildlife sightings remain natural wildlife encounters and cannot otherwise be absolutely guaranteed.
9. ARRIVAL REQUIREMENTS
Guests must arrive at least 30 minutes prior to departure.
Late arrivals may be denied boarding.
Missed departures due to late arrival are treated as no-shows and are non-refundable.
10. CHILDREN
Tours are family-friendly.
Children under 18 must be accompanied by a parent or legal guardian.
Children’s bookings must be made by a responsible adult.
Infant participation remains subject to weather, sea conditions, and safety considerations.
Moby Dick Tours reserves the right to restrict participation where safety requires.
11. HEALTH & FITNESS
Customers are responsible for ensuring that they are medically fit to participate.
Guests should inform staff of relevant health concerns where necessary.
Participation may not be suitable for individuals with:

severe mobility limitations

certain medical conditions
-
high-risk pregnancy situations
-
serious sea sickness sensitivity
Participation remains at customer discretion unless restricted for safety.
12. SAFETY AUTHORITY
The captain and authorized crew maintain absolute operational authority at all times.
All passengers must comply with:

crew directions
-
boarding procedures
-
emergency requirements
-
vessel conduct rules
Failure to comply may result in denied boarding or removal without refund.
13. CUSTOMER CONDUCT
Customers must behave respectfully toward:

crew

passengers

wildlife
-
equipment
-
vessel property
The following may result in removal:

intoxication
-
abusive behavior
-
dangerous conduct
-
harassment
-
property damage
-
refusal to follow safety instructions
No refund will be issued in such cases.
14. WILDLIFE DISCLAIMER
Marine wildlife is wild and unpredictable.
While sightings are frequent, animal behavior, movement, and environmental conditions cannot be fully controlled.
Customers acknowledge that nature-based experiences inherently involve unpredictability.
15. LIABILITY LIMITATION
To the maximum extent permitted by law, Moby Dick Tours shall not be liable for:

indirect losses

consequential damages
-
personal property loss
-
missed onward travel
-
accommodation disruption
-
personal inconvenience
-
customer negligence
-
circumstances outside reasonable control
Nothing in these Terms excludes liability where exclusion is prohibited by law.
16. PERSONAL PROPERTY
Guests are responsible for their own belongings.
Moby Dick Tours is not liable for:

lost items

damaged belongings
-
stolen property
-
electronic equipment damage
-
water exposure damage
17. PHOTOGRAPHY & MEDIA
Customers may take personal photographs unless restricted for safety.
Moby Dick Tours may capture promotional photography or video during tours.
By participating, customers acknowledge that general event imagery may be captured.
Customers may request exclusion where reasonably practicable.
18. WEBSITE USE
Users agree not to:

violate applicable laws
Unauthorized use may result in legal action.
19. INTELLECTUAL PROPERTY

20. FORCE MAJEURE
Moby Dick Tours shall not be liable for failure or delay caused by events beyond reasonable control, including:

These Terms are governed by Portuguese law.

3. RESERVAS
A reserva apenas se considera confirmada após:

pagamento validado

confirmação oficial
4. CANCELAMENTOS
Cancelamento gratuito até 24 horas antes da partida.
Após esse prazo poderá não existir reembolso.
5. NÃO COMPARÊNCIA
Não comparência implica ausência de reembolso.
6. CANCELAMENTO OPERACIONAL
Cancelamentos por condições meteorológicas, segurança ou motivos operacionais poderão originar:

reembolso total OU
-
reagendamento
7. GARANTIA DE AVISTAMENTO
Caso não sejam observadas baleias nem golfinhos num tour elegível, poderá aplicar-se reembolso total, sujeito à verificação operacional.
8. SEGURANÇA
O capitão e tripulação têm autoridade total operacional.
O incumprimento de instruções poderá resultar em exclusão sem reembolso.
9. CRIANÇAS
Menores devem estar acompanhados por responsável legal.
10. RESPONSABILIDADE
A empresa não responde por perdas indiretas, objetos pessoais ou situações fora do seu controlo legalmente permitido.
11. LEI APLICÁVEL
Aplicação da lei portuguesa.
